We at Mannkaa (formerly named ChatADoc) pledge our commitment with sincerity to respect the privacy and confidentiality of the information that you entrust us with. This Policy (hereinafter “Privacy Policy”) describes how personal information shared with us about our users may be used and disclosed.

Please review it carefully. If you accept the Terms and Conditions along with this present Privacy Policy, you agree to the terms mentioned in the Privacy Policy.

Objective

This Privacy Policy discloses Mannkaa’s practices for their website as well as mobile application including the type of information being collected, method of such information collection, use of such information and sharing of such information with third parties. This document comprises our Privacy Policy and is accessible to our users who provide us such information, on our website www.mannkaa.com as well as on our mobile application.

Definitions

Mannkaa, “we,” “our,” “us,” “Service Provider,” “Company” or similar terminology are all in reference to Source of Life Technologies Pvt. Ltd. as a provider of Services to our users for the remainder of this document.

“User,” “Client” or “You”, including its grammatical variations, means any natural person using our Services.

“Platform” or similar terminology are all in reference to any mobile app, website or web links that the User can employ to access Services provided by us.

“Psychological Wellness Professional” are trained to assess and support people with common mental health problems or conditions – like anxiety disorders and depression – to manage their recovery.

“Personal data” means and includes the details provided by our users at the time of creation of Website user account or at the time of making an account via our mobile application and any proof of compliance such as scanned copies of forms, internal memos, statutory documents, reports, filings, applications, notices, etc. submitted by you through any of our platforms.

“Privacy Policy” means the privacy policy available at www.mannkaa.com/privacypolicy.

“Website” means the website www.mannkaa.com which is a web-based proprietary service platform of Mannkaa.

“Services” shall mean providing psychological counselling services to the Client/ User for any challenges or issues Client/User may be facing in their lives. Services shall not include providing psychological counselling to Users with severe clinical disorders or psychotic conditions or Clients/ Users with medical emergencies like suicidal tendencies.

Our scope of Services includes providing you with lists and/or profile previews of mental healthcare experts, Counsellors, therapists or doctors based on information that you provide to the Application’s search features (such as area of specialty, conditions, gender, language)

NATURE OF SERVICE

Mannkaa a psychological wellness platform committed to delivering emotional well-being Services to individuals and organisations. These include, but are not restricted to, organizational wellness programmes, providing employees and affiliated individuals with access to a variety of Services. Our offerings may include/are:

  • Online consultations with expert Psychological Wellness Professionals or Counsellors (who have been authorised by us to use the platform for delivering their Services) guaranteeing a personalized and supportive approach to mental health care while prioritizing privacy and confidentiality.
  • Regular self-assessments and psychological tests.
  • Workshops and/or webinars conducted by certified and trained Psychological Wellness Professionals/Counsellors.
  • Content and programmes delivered through a range of channels including, but not restricted to websites, mobile applications and emails.
  • Engagement in user forums, discussions, topics, replies, comments, feedback, blogs and any other submissions on the platform.

We reserve the right to add or remove products and Services from its overall offerings without prior notification. The aforementioned shall hereinafter be referred to as “Services”.

  • We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.
  • We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill. We will not be liable to you in respect of any special, indirect or onsequential loss or damage.
  • Our role is that of an ‘intermediary’ as defined under the Information Technology Act, 2000 and the rules thereunder. Being an intermediary, Mannkaa has no responsibility and/ or liability in respect of the content and transactions on the Website and application including any User information provided by Counsellors, interactions between Counsellors on the one hand and Users on the other hand.
  • We do not have the obligation to pre-screen or monitor User Content or Counsellor Content at any time. However we may elect to monitor any User Content and remove any User Content from our platform if we determine in its sole discretion that such User Content is in violation of the Terms and Conditions and this Privacy Policy or any applicable law and best practices. Where we remove any User Content from our platform, we will make reasonable efforts to inform the User who had posted such User Content. Such actions do not in manner negate or dilute Mannkaa’s position as an intermediary or impose any liability on us with respect to User Content.
  • If Mannkaa suspects any illegal, wrongful or fraudulent activity on the Website by any Registered User, notwithstanding any other rights we may have, we reserve the right to inform the relevant government or law enforcement authorities.
  • We will cooperate in all investigative procedures or requests for access/ information initiated by any such government or law enforcement authorities.
  • We do not endorse or influence control over any particular branch of medicine, theory, opinion, viewpoint or position on any topic.
  • We are not in the business of providing psychiatric care or treatment for severe mental illnesses including but not limited suicidal thoughts. We reserve the right to decline services where we think that psychiatric care is a must.
  • Mannkaa disclaims any and all liability for any consultation and therapy services rendered by a Counsellor to you through our platform. You further acknowledge and agree that you take full responsibility for the decision to access a Expert through our platform and to continue to interact with such individual(s), and that our Company’s role is strictly limited to providing access to such Counsellors to you.
  • The website is not a suicide helpline platform. If you are considering or contemplating suicide or feel that you are a danger to yourself or to others, you may discontinue use of the services immediately at your discretion and please notify appropriate police or emergency medical personnel.
  • We reserve the right to make changes to these Terms at any time. Any such modifications will become effective immediately upon posting to the Website and the mobile application and your continued use of the Website, the application, and/or the Services constitutes your agreement to such modifications. You agree to periodically review the current version of these Terms as posted on the Website and mobile application(s.)

PRIVACY PRINCIPLES

Our Privacy Policy is centred around informing you of your rights to the Personal Information which we may collect from you where you use our platform to render our Services.

Consent

By using our platform, providing us your Personal Information or by making use of the features provided by the platform or by making a payment to us, you hereby provide your consent to the collection, storage, processing, disclosure and transfer of your “Personal Information” (mentioned below) in accordance with the provisions of this Privacy Policy and under the data privacy laws in India.

You acknowledge that you are providing your Personal Information out of your free will, either directly to us by using our platform. You have the option to not provide us the personal information sought to be collected. You will also have an option to withdraw your consent at any point, provided such withdrawal of consent is intimated to us in writing to info@mannkaa.com Notwithstanding this, if you are accessing our platform through a third-party or your organisation, you will have an option to withdraw your consent at any point, provided you explicitly inform the third party or your organisation about such withdrawal of consent in writing, who would then inform us to take the appropriate action.

If you do not provide us with your Personal Information or if you withdraw the consent at any point in time, we shall have the option to not fulfil the purposes for which the said Personal Information was sought and we may restrict your use of the platform.

Mannkaa collects information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular user. We may have collected the following categories of personal information from users through our platform. We also collect information you provide from responses, in-app inputs, assessments or the feedback you send to us. If you communicate with us by email or phone, any information provided in such communication may be collected as personal information (“Personal Information”).

Your information is used on our platform algorithms to better assess your condition and provide you with the most suitable service or digital experience. However, there may be certain occasions when we use third-party tools to tailor the services and in-app experience. In such cases, only minimal information as required is shared with others.

Updating Personal Information

If your Personal Information changes, or if you need to update or correct your Personal Information or have any grievance with respect to the processing or use of your Personal Information, for any reason, you may send updates and corrections to us at info@mannkaa.com and we will take all reasonable efforts to incorporate the changes within a reasonable period of time. If you provide your Personal Information to a third-party platform from which you are using our Services, we may not be able to make any changes to the same and you will have to contact the third-party platform in order to update your Personal Information

If your Personal Information is stored as part of your profile on the platform, you can update your Personal Information from our website or mobile application(s).

Some Personal Information, such as your answers to online assessments cannot be updated or deleted once submitted. If you would like us to remove your records from our system, please contact us at info@mannkaa.com and we will attempt to accommodate your request if we do not have any legal obligation to retain such information.

Please note that we are required to retain certain information in keeping with professional standards or by law for record maintaining purposes (including but not limited to payment history, feedback, client information, etc.), so we will continue to store this information for a pre-specified period of time as per applicable laws, even if you delete your account. There may also be residual information that will remain within our databases and other records, which, irrespective of any efforts by us to delete information, will not be removed from them

Cookies

We use “cookies” to collect information and smoothen your experience on our platform. A cookie is a small data file that we transfer to your device’s hard disk for record-keeping purposes. We use cookies for two purposes. First, we may utilise persistent cookies to save your user credentials for future logins to the Services. Second, we may utilise session ID cookies to enable certain features of the Services, to better understand how you interact with the Services and to monitor aggregate usage by users of the Services and online traffic routing on the Services. Unlike persistent cookies, session cookies are deleted from your computer when you log off from the Services and then close your browser.

In such cases, by using the third party services through our platform, you consent to their Privacy Policy and terms of use and agree not to hold Mannkaa liable for any issues arising from such use. If you do not accept cookies, however, you may not be able to use all features or functionalities of the platform.

Log Data

When you visit the platform, our servers automatically record information that your browser or mobile application sends (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, device name, operating system version, configuration of the app when accessing the Platform, the webpage you were visiting before you came to our Services, pages of our platform and Services that you visit, the time spent on those pages, information you search for on our Services, access times and dates, and other statistics. We use this information to analyse trends, administer the site, track your location, gather broad demographic information for aggregate use, increase user-friendliness and tailor our Services to better suit your needs.

Confidentiality

If there is a threat to the well-being of the user themselves or to someone else (cases involving harm to self or harm to others), we will be obligated to share information with the clinical supervisor and others, including emergency contacts, and other people deemed fit and essential to maintain safety, including but not limited to family, friends and law enforcement authorities, or to comply with legal requirements.

If we receive knowledge of any criminal activity, including present or past abuse of minors, senior citizens or disabled persons, they will be obligated to share information with law enforcement authorities, and to comply with all legal requirements. In the event that you are required to seek a consultation’ from another mental health or medical professional, clinically significant information can be shared with the relevant professional with your consent. In the process of supervision, other counsellors may have access to information and notes as needed for clinical excellence and safety. All reasonable attempts will be made to inform you before any information is shared with a third party outside Mannkaa.

We will share or disclose your information where it is deemed to be necessarily disclosed in response to any law enquire, judicial process or government enquiry, or in event of suspicion of violation of our policies or to protect the right or safety of any person or entity.

Except for the reasons outlined above, the Personal Information shared on our platform will only be shared with others after permission has been granted by you orally or by way of email/letter.

The User agrees to indemnify Mannkaa for any breach in confidentiality of the User’s Personal Information. If the User accesses the platform through a third-party platform the User indemnifies Mannkaa against any data breaches that occur due to any acts of commission or omission from the third-party platform.

Third Party Disclosure

We do not sell or trade your Personal Information to third parties unless we provide you with advance notice. However, this does not apply to any storage or transfer to and from server/website hosting partners and other parties who assist us in operating our platform, conducting our business, or servicing you. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, mobile application policies, or protect ours or others’ rights, property, or safety. However, visitor information that is not personally identifiable may be provided to other parties for marketing, advertising, or other uses.

Security

We employ administrative, physical, and technical measures designed to safeguard and protect information under our control from unauthorised access, use, and disclosure. When we collect, maintain, access, use, or disclose your Personal Information, we will do so using systems and processes consistent with industry standards in information privacy and security. None of the call or video sessions are recorded. All our sessions are encrypted. In keeping with professional standards, Counsellor might be required to maintain records of both online and offline sessions.

In spite of the security measures undertaken by us, we strongly discourage you from posting your Personal Information in forums, comments or any other publicly accessible places on our platform. We shall not be held responsible for use or misuse of any information pertaining to or shared by the User with relation to our Services. The User will not hold us liable for any issue related to data storage and/or security.

It is your responsibility to ensure the privacy and security of your email account and phone messages so they cannot be accessed by third-party. Mannkaa will use one or both of these channels to communicate with you regarding a range of information related to your psychological wellness. We shall not be liable for any breach in confidentiality, should your email or text messages be accessed by a third-party, with or without your consen

Links

The platform may contain links to other third party sites. The third party sites are not necessarily under the control of Mannkaa. Please note that we are not responsible for the privacy practices of such third party sites. We encourage you to be aware when you leave the platform and to read the privacy policies of each and every third party site or mobile application that collects Personal Information. If you decide to access any of the third-party sites linked to the platform, you do this entirely at your own risk. Any links to any partner websites is the responsibility of the linking party, and we shall not be responsible for notification of any change in name or location of any information on the websites. Mannkaa is not responsible for the use of any Personal Information that you voluntarily disclose through a forum or through the platform.

Persons below the age of 18

Our Services, website, and mobile application(s) are not directed to persons under the age of 18 years. We do not knowingly solicit anyone under the age of 18 to participate independently in any of our Services

Cancel Appointment Policy

  • Our goal is to provide quality health care to all our patients in a timely manner. No-shows, late cancellations, and cancellations are inconvenient not only for our providers but our other patients as well. Please be aware of our policy regarding the cancellation of appointments.
Appointment Cancellation
  • When you book your appointment, you are holding space on our calendar that is no longer available to our other patients. In order to be respectful of your fellow patients, please be available for appointments at the scheduled time. If cancellation is necessary, we require that you call in advance. Appointments are in high demand, and your advanced notice will allow another patient access to that appointment time.
How to cancel your appointment
  • If you need to cancel your appointment, please go to the approved sections and press on the cancel appointment, you have to leave a reason for cancellation.
Late Cancellations/No-Show
  • A cancellation is considered late when the appointment is cancelled less than 12 hrs before the appointed time. A no-show is when a patient misses an appointment without cancelling. In either case, we will charge the patient a cancellation or missed appointment fee.
Cancellation by the user
  • For a session cancellation earlier than 12 hrs before the scheduled appointment, there will be 100% refund.
  • For a session cancellation within 12 hrs of the scheduled appointment, there will be 50% cancellation charges.

Changes to policy

We reserves the right to modify or remove any part of the Privacy Policy without notice or liability to anyone. In the event there are significant changes in the way we treat your Personal Information, or in the Privacy Policy, we may take reasonable effort, but are in no way obligated, to display a notice on the website or our application or send you an email, so that you may review the changed terms prior to continuing to use the platform.

As always, if you object to any of the changes to our terms, and you no longer wish to use the platform, you can contact us to discontinue using our platform.

Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account. Using the Services on the websites, mobile application(s) or accessing the websites, mobile application(s) after a notice of change has been sent to you or published on our website shall constitute your consent to the changed terms.

The new updated policy will be available on all our platform.

Grievance Redressal

To address the grievances of the users, Mannkaa has set up a Grievance Redressal Forum. We assure you a time-bound response not exceeding one month from the date of your complaint.

Jurisdiction

Jurisdictional policies of Mannkaa have been drafted in accordance and compliance with Indian laws. Any and all disputes arising between the user and Mannkaa with regards to this Policy, including the interpretation of the terms of this Policy shall be subject to the exclusive jurisdiction of the courts at Gurugram, Haryana, India.
